2. Data Controller
For the processing activities described in this policy — such as orders, customer support, marketing subscriptions and educator enquiries — the data controller is Emprezz s.r.o., registered at Žitná 562/10, Nové Město, 120 00 Praha 2, Czech Republic.
Because the operator is established in the Czech Republic, the EU General Data Protection Regulation (GDPR) applies to our processing. Some service providers (for example, payment or hosting services) may process certain data independently under their own privacy policies; we do not control that independent processing.
3. Information We Collect
We collect only the information needed to run this website and our educational services. Depending on how you interact with us, this may include:
- Adult customer name and email address.
- Billing and purchase information for digital orders (processed by our payment provider — see Section 6).
- Purchase history and download records.
- School and educator enquiry details you choose to share.
- Customer support messages.
- Newsletter and marketing preferences, only where you have opted in.
- Technical information such as browser type and approximate device data.
We distinguish between information we collect directly (for example, forms you complete) and information processed by service providers on our behalf (for example, payment processing). We do not store full payment card details on our own systems.
4. How We Use Information
We use personal information only for clear purposes:
- Processing orders and delivering digital products.
- Providing customer support and responding to enquiries.
- Sending educational resources you have requested.
- Managing classroom and school licenses.
- Sending marketing emails only where legally permitted and consented.
- Preventing fraud and maintaining website security.
- Meeting legal and accounting obligations.
Where data protection law requires a lawful basis, we rely on the basis appropriate to each purpose — for example, performance of a contract for orders, consent for optional marketing, and legitimate interests for security and service improvement.
5. Children's Privacy
Sam & Max creates educational content for children ages 5–15, but our commercial transactions, marketing and educator enquiries are intended for adults.
- Children should not independently submit purchase, marketing or contact forms.
- The public classroom demonstration does not require student accounts, names or personal contact details.
- Choices made in the public demo stay on the visitor's device and are not used for behavioral advertising.
- Any future collection of children's personal data would require a separate legal and technical review before launch.
We do not claim formal COPPA, UK GDPR or Children's Code certification. Before any child-directed data processing is introduced, third-party scripts, analytics and embedded services will be audited for child-privacy impact.
6. Payments and Billing
Online checkout is not yet active on this website. When digital purchases launch, payments will be processed by an external payment provider; card details will be handled by that provider and not stored on our systems. This section will be updated to name the provider once integration is complete.
8. Third-Party Service Providers
We do not currently share personal information with third-party data processors beyond essential website hosting. This list will be completed with verified providers — such as payment, email delivery or analytics services — before any such service is activated.
9. Data Retention
We keep personal information only for as long as needed for the purpose it was collected — for example, order records for the period required by accounting and tax law, and support messages for as long as needed to resolve your enquiry.
Exact retention periods will be published here once the relevant systems are configured; we do not state periods we have not implemented.
10. International Data Transfers
Our website is delivered through international hosting infrastructure, so technical data may be processed in more than one country. Where personal data is transferred outside the European Economic Area, we apply the safeguards required by the GDPR — such as adequacy decisions or standard contractual clauses — and will name the relevant providers in Section 8 once configured.
11. Your Privacy Rights
Depending on where you live, you may have the right to:
- Access the personal information we hold about you.
- Correct inaccurate information.
- Request deletion of your information.
- Restrict or object to certain processing.
- Receive a portable copy of your data.
- Withdraw consent where processing is based on consent.
- Complain to your local data protection supervisory authority.
As we are established in the Czech Republic, the GDPR applies to our processing; US state privacy laws and UK data protection law may also apply depending on our activities and legal thresholds. We will honor the rights that apply to you, including the right to complain to a supervisory authority (in the Czech Republic, the Office for Personal Data Protection — ÚOOÚ). To exercise any right, contact us using the details in Section 14.
12. Security
We use appropriate technical and organizational measures, including encrypted connections (HTTPS) and access controls, to protect personal information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security — but we work to keep risks low and collect only what we need.
13. Changes to This Policy
If we make material changes to this policy, we will update the “Last Updated” date above and, where appropriate, notify registered customers by email before the changes take effect.
